1. What this is
Fridgee is a social network where you publish photos of your fridge and other users rate them. The operator is [[OPERATOR – most likely: oerli GmbH]], [[ADDRESS]] ("we"). These terms apply to the website fridgee.net and to the Fridgee apps.
By registering you agree to these terms and to the Community Guidelines.
2. Who can join
- You must be at least 16 years old.
- One account per person. Accounts are not transferable and are not for sale.
- Your username must not infringe third-party rights or pretend you are someone else.
- We may refuse a registration without giving reasons.
3. Your account
You are responsible for your password. If you suspect someone else has access, change it immediately (this logs out all other devices) and write to service@fridgee.net.
You can delete your account in the app at any time (Settings → Your data → Delete account). After deletion there is a 30-day grace period during which you can log back in and cancel the deletion. After that, it's gone.
4. What you upload
You may only upload content
- that you created yourself or for which you hold the necessary rights,
- that does not breach the Community Guidelines,
- that does not infringe third-party rights (copyright, trade marks, personality rights),
- that does not contain undisclosed advertising.
Prohibited in particular: depictions of violence, nudity and sexual content, hate and insults, bullying, threats, harmful misinformation, content involving minors, spam, bulk uploads, automated accounts, circumventing bans, scraping the platform without our written consent, and any attempt to manipulate votes.
5. Rights in your photos
Your photos are yours. You keep all rights in them.
So that we can run Fridgee, you grant us a non-exclusive, royalty-free licence, unlimited in time and territory, to store your content, reproduce it, convert it into other image formats and sizes, make it publicly available and display it within the service – including link preview images, the ranking and fridge type cards.
This licence covers only the operation and promotion of Fridgee itself. We do not sell your photos, do not pass them to advertising partners and do not use them in paid third-party advertising. If we want to feature a post on our own channels (Instagram, TikTok, press), we ask you first. [[review: is asking enough, or should there be an opt-in in Settings?]]
If you delete a post or your account, the licence ends. Copies already made in backups disappear with the regular backup cycle ([[30]] days).
6. Other people in your photos
Fridge fronts often carry photos, drawings, invitations and keepsakes – and with them, other people. Only upload such images if the people shown agree. For children you need the consent of their guardians.
Before uploading we offer on-device face detection and suggest blurring faces. That is a tool, not legal advice – the responsibility stays with you.
If someone recognises themselves in a photo and does not want it published, they can use the report function or write to service@fridgee.net; we will remove the image.
7. Votes and comments
Votes (▲/▼) and comments are other users' opinions. We give no guarantee that your fridge will go down well. Manipulating votes – through second accounts, bought votes or automated scripts – leads to suspension.
You can block users (you then no longer see each other) and report content.
8. Reporting, decisions, appeals (DSA)
Every post, comment and profile can be reported in the app ("Report"). You receive a case number.
We review reports promptly and decide on one of the following: do nothing, remove the content, limit its reach, issue a warning, suspend temporarily, suspend permanently. We inform both sides – the reporter and the person affected – of the decision, with reasons (Art. 16, 17 DSA).
If you disagree with a decision you can appeal within 6 months: service@fridgee.net, subject "Appeal", with the case number. We review the case again, and not through the same person who decided first. Independently of that, you may use an out-of-court dispute settlement body under Art. 21 DSA and the courts.
Anyone who repeatedly posts manifestly illegal content, or repeatedly files manifestly unfounded reports, will be suspended after a prior warning (Art. 23 DSA).
9. Availability
We try hard, but we do not owe a specific level of availability. Maintenance, faults and further development may cause interruptions. We may change or discontinue features; we announce material changes in advance.
10. AI features
Food recognition, recipe suggestions, fridge types and roasts are generated by artificial intelligence and are labelled as such. They can be wrong.
- Always check food and expiry dates yourself. Never rely on Fridgee for allergies, intolerances or spoilage.
- Recipes are suggestions, not nutritional or medical advice.
- Roasts are a joke. If a line hits wrong: report it, we'll take a look.
Free use of the AI features is subject to quotas (see Settings).
11. Fridgee Pro [[if applicable]]
[[Price, term, billing via App Store / Play Store / own payment provider, renewal, cancellation, right of withdrawal under § 355 BGB and the exception for fully performed digital services. Where billing runs through the stores, their terms apply in addition. This section is not drafted yet.]]
12. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations and limited to the typical, foreseeable damage. Liability is otherwise excluded.
We are not liable for other users' content and do not adopt it as our own.
13. Termination
You can leave at any time (section 3). We may suspend or terminate your account if you materially or repeatedly breach these terms or the Community Guidelines – usually after a prior warning, and immediately in serious cases (e.g. content involving minors, criminal offences).
14. Changes to these terms
We will tell you about changes in the app at least [[30]] days in advance. If you do not object before they take effect, or continue to use Fridgee afterwards, the new terms apply. We point this out expressly in the announcement. You can terminate at any time.
15. Final provisions
German law applies. If a provision is invalid, the rest remains effective. Place of jurisdiction is [[CITY]] insofar as you are a merchant or have no general place of jurisdiction in Germany. Consumers may sue us at their place of residence; mandatory consumer protection rules remain unaffected.
